California Supplemental Paid Sick Leave

Dear Employee:

Senate Bill 95, Supplemental Paid Sick Leave (SPSL), recently signed by Governor Newsom, provides immediate COVID-19 paid sick leave to employees, up to 80 hours for full time appointments.  Part time employees and those with variable schedules will receive hours based on their FTE or average number of hours worked for the past six months (or less for new hires).  The new law applies retroactively to January 1, 2021, and expires on September 30, 2021, unless extended.

There are three main categories of reasons:

  •  Caring for oneself.  An employee is entitled to COVID-19 SPSL if the employee is unable to work or telework because the employee is subject to a quarantine or isolation period related to COVID-19, has been advised by a healthcare provider to quarantine due to COVID-19, or is experiencing symptoms and is seeking a medical diagnosis.
  •  Caring for a family member.  An employee is entitled to COVID-19 SPSL if the employee is unable to work or telework because the employee is caring for a family member who is subject to a quarantine or isolation period related to COVID-19, or the employee is caring for a child whose school or daycare is closed or unavailable due to COVID-19.
  •  Vaccine.  An employee is entitled to COVID-19 SPSL if the employee is unable to work or telework because the employee is attending a vaccine appointment, or is experiencing vaccine-related symptoms.

Please note being subject to a general stay-at-home order does not qualify an employee for the Supplemental Paid Sick Leave.  Rather, quarantines and isolation periods must meet the definition or guidelines set forth by the California Department of Public Health, the federal CDC, or a local health office who has jurisdiction over the workplace.

Effective April 9, 2021 payroll, full time faculty and Administrative Professional employees will notice the COVID-19 leave balance as a separate line item under Leave titled “COVID-19 SB5”.  For classified, adjunct faculty, student employees, and temporary employees, the balances will show effective April 26 payroll.
