If a process server attempts to serve a subpoena for University records, the person should be redirected to the Office of General Counsel. If the subpoena is addressed to a specific employee by name or job title and relates to University business, then personal service is required and the named person should accept service.
If a specific employee by name or job title has been served and it relates to University business, below are instructions how to proceed:
- Fill out the Cover Page and Checklist-The information on the Cover Page is asking for service information and instructing the person served to notify students/employees when their personal records are subpoenaed. The checklist is to determine if the subpoena is valid before complying.
- Cover Page and Checklist
- Template – Notice Advising Student or Employee re Subpoena for Personal Records
- Template – Objection Letter to Issuing Entity Regarding Defects in Subpoena or Service
If you need further guidance on how to respond to the subpoena or have any other questions please email the completed Cover Sheet, Checklist, and the subpoena to OGC@laverne.edu for review.
Please note this protocol does not apply to subpoenas addressed to a specific person and unrelated to a University matter. In such a case, the named person should seek the advice of private legal counsel at his or her expense.
