Definitions

Explicit, informed, and voluntary agreement to participate in a sexual act.

The act of stepping in to prevent or stop harmful, inappropriate, or dangerous behavior.

University employee who is clergy, or a licensed medical, clinical or mental health professional and those performing services under their supervision or as their administrative or operational support, when acting in their professional role in the provision of services to a patient (ULV Policy).

An act of sexual penetration, however slight, of the genitals committed with a person against their will by means of:

  • Force, violence, duress, menace, or fear of immediate and unlawful bodily injury to themselves or another person.
  • When the victim is incapable of giving legal consent because they are unconscious, asleep, or otherwise unable to resist.
  • When the victim is prevented from resisting due to intoxication, medication, or a mental disorder and the perpetrator knew or should have known this.
  • When the victim is under 18 and the harm doer is 18 or older and engages in sexual intercourse.

Responsible Employees include all faculty and staff who are not listed as a Confidential Reporting Source (see above). Responsible employees also include Resident Assistants, Graduate Teaching Assistants, and all other studentemployees, when disclosures are made to any of them in their capacities as employees. (ULV Policy).

A comprehensive medical and forensic examination provided to sexual assault survivors by specially trained healthcare professionals, often part of a SART team. Exams include collecting evidence, assessing injuries, providing medical treatment, and offering emotional support.

Any sexual act committed against someone without their consent, including when the person is incapable of giving consent.

A form of sex discrimination involving unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature.

When a person willfully, maliciously, and repeatedly follows or harasses another person and makes a credible threat with the intent to place that person in reasonable fear for their safety or the safety of their immediate family.

A trained professional protected under CA Penal & Evidence Codes who provides confidential support, information, and resources to individuals affected by crimes such as domestic violence, dating violence, sexual assault, or stalking. They help survivors navigate the legal system, access counseling and medical services, and connect with community resources, offering emotional support and guidance throughout their recovery process.
